How to File an Eviction Notice in Delaware

    • 1). Read over the State of Delaware's Real Eviction Law. Find the section in the law that justifies your ability to evict your tenant.

    • 2). Write your tenant a letter. Include the reason for the eviction, give them one week to correct the problem, inform the tenant that if the problem is not rectified, then they must vacate the premise. Explain that if the problem repeats within one year, you have the right to take the tenant to court for eviction.

    • 3). Deliver the note directly to the tenant to ensure he receives it.

    • 4). File a complaint for possession with your local Justice of the Peace Court if the tenant does not meet your demands. File with the court in the same county as your rental unit. The court then starts legal proceedings to resolve the issue.
