How to Add a Creditor After Bankruptcy Confirmation

    • 1). Call the trustee assigned to your bankruptcy petition. This person's name and telephone number are located on the petition confirmation sent to you by the bankruptcy court. Explain to the trustee or clerk that you found an undeclared debt and need to amend your petition.

    • 2). Obtain the proper forms required by your court. Some trustees require a completely new petition listing all personal information, income, debt and assets. Other trustees only want to see the amended information on a new form. Forms are available via the trustee's office or the U.S. Courts website under "Bankruptcy Forms" (see Resources).

    • 3). Complete the amendment forms as directed by the trustee or the clerk. Include a cover letter with the amendment forms stating your case number, the reason for amendment and a brief explanation of the change.

    • 4). Sign the forms, noting "amended" in the bottom margin so the trustee is not confused by similar forms and statements. Ask the clerk if you need to make any particular number of copies before submitting.

    • 5). Make any necessary copies and file the forms with the bankruptcy court or directly with the trustee if directed to do so. Pay any applicable fees -- not all amendments require fees.
