Steps to Evict Someone in Michigan

    Notify the Tenant

    • 1). Download Form DC100 (notice to quit) from the Michigan courts (courts.michigan.gov) website or request the appropriate form from the clerk of the district court.

    • 2). Complete the form. Provide the tenant's name as listed on the lease, address of the rental property, reason for eviction, timeframe for the tenant to rectify the situation, date of notice and your signature.

    • 3). Deliver the notice personally to the tenant or to another adult member of the household. The notice can also go via First Class mail.

    File Complaint and Deliver Summons

    • 1). Access Form DC102 (complaint) and DC104 (summons) on the Michigan courts website or obtain the proper forms through the county district court. Do this only if your tenant has not taken remedial action in the timeframe stipulated in the original notice.

    • 2). Complete the complaint and summons with all required information. Attach copies of the notice to quit and the lease to the complaint.

    • 3). Submit the completed complaint and summons, supporting documentation and applicable filing fee to the clerk of the district court. As of 2011, the fee was $45 to file and may increase if monetary damages are sought.

    • 4). Retain one copy of all filed documents for your records and two copies of all documents to be served on the tenant.

    • 5). Send one copy of the complaint, summons and supporting documents to the tenant's current mailing address via First Class mail. Deliver the other copy of these documents either to the tenant personally, to an adult household member or via certified mail with return receipt requested.

    Attend Hearing and Obtain Judgment

    • 1). Attend the scheduled hearing at the district courthouse.

    • 2). Bring any documentation the judge should consider, such as proof of property ownership, correspondence between you and the tenant, photographs, police reports or a statement of the tenant's payment history.

    • 3). Take your turn before the judge to present the reason you are seeking eviction and available evidence. If the tenant does not appear at the hearing or is unable to provide adequate defense to your eviction action, the judge will issue an order of eviction.
