California CVC Motor Vehicle Safety Act
- The term "motor vehicle" refers to a passenger vehicle, motor truck or a truck tractor, while excluding motorcycles. "A person shall not operate a motor vehicle on a highway unless that person and all passengers 16 years of age or over are properly restrained by a safety belt," reads the law. .
- Those actively engaged in the delivery of newspapers are not held to the law, and the statute also does not apply to the operator of a taxicab, provided the taxi is at work on a city street and carrying a paying passenger. In any case, a passenger over 6 years of age in the front seat of a taxi must be restrained by a safety belt.
- The law provides for fines of $20 for a first offense and $50 for all subsequent infractions. In lieu of a fine for first offenses, a court may direct the scofflaw to a traffic school safety course that provides instruction on the proper use of safety restraints.
