How to File for an Absolute Divorce in Oklahoma

    • 1). First things first, you will need to completely fill in all of your documents and take your documents to a notary for signing. Please sign the following documents in front of a notary:
      ?Petition for absolute divorce (needs signed but not notarized)
      ?Certification of Verification and Non-Collusion
      ?Motion for waiver of hearing
      ?Pauper's Affidavit

    • 2). Next you will need to make copies of all of the forms, please advise the number of copies for each of your forms:
      ?Petition for absolute divorce (3 copies)
      ?Certification of Verification and Non-Collusion (3 copies)
      ?Pauper's Affidavit (2 copies)
      ?Decree of Divorce (3 copies)

    • 3). After that you will need to contact your spouse and give them their forms to notarize. You should give your spouse the following:
      ?1 copy of the Petition for absolute divorce for them to keep
      ?1 copy of the Certification of verification and Non-collusion
      ?The original Motion for waiver of hearing with your notarized original signature
      ?The original Affidavit of consent for your spouse

    • 4). On the day that you give the copies of the papers to your spouse, sign and date the Proof of Service.

    • 5). Once your spouse returns all of the notarized original documents to you, please make the following copies:
      ?Motion for waiver of hearing (3 copies)
      ?Affidavit of consent (3 copies)
      ?Proof of service (3 copies)

    • 6). Now that all of that is done, you can proceed to the case filing. I understand how difficult getting to the courthouse can be so your forms can be mailed to the court if you would like. This is what you should include in your mailing along with the filing letter to the court (only use the filing letter if you are mailing these):
      ?Original Pauper's Affidavit and one copy
      ?Original Domestic Relations case cover sheet
      ?Original Petition for Divorce and one copy
      ?Original Certification of Verification and one copy
      ?Original Proof of service and one copy
      ?Original Affidavit of consent from your spouse and one copy
      ?Original Motion for waiver of hearing and one copy
      ?Original Decree of Divorce and two copies

    • 7). If you are taking the forms in person, the list above still applies, however do not file the filing letter. It is unnecessary when you taking the forms to court in person.
