How to Fight a Ticket for Not Entering a Weigh Station

    • 1). Review the laws of the state in which the alleged violation occurred. The ticket will have a specific charge on it, along with the fine required and the court date set for fighting the ticket. Blowing by scales is illegal in all states, but you need to check your specific set of circumstances.

    • 2). Contact the organization that issued the ticket and explain your circumstances. Open a dialog with the issuer to come to a workable conclusion. If there is a misunderstanding, or if there was some kind of technical glitch -- many truckers use a pre-clearance system that allows them to drive by, which can err just like any other technical system -- then it will be easier to work out if you show you're willing to be proactive during the process.

    • 3). Attend the court hearing. If you really want to fight your ticket, then attend court on the date listed on the ticket rather than paying it. Listen to the evidence against you and give your own testimony about what happened. If you have evidence, you want to present, such as a statement from a technician showing your pre-pass system was faulty; this would be the time to do it. Your goal here is to show that what happened was not your fault, and that you are trying to make things right.
