How to Defend a Small Claims
- 1). Read the claim against you. Pay attention to all the details of the case such as the name of the person suing you, what the claim against you is, and the court time, date and location.
- 2). Decide if your position is legally defensible. Take the time to reflect on the claim against you. If you come to the realization that the plaintiff is in the right, make arrangements to pay him. If you think that you are being wrongly sued, make arrangement to present your version of the events.
- 3). Collect documentation and evidence for your case. Gather the materials that pertain to your case such as letters, lease agreements, receipts of payment, canceled checks, written contracts and photographs.
- 4). Arrange for witnesses to testify on your behalf. Talk to witnesses that have specific knowledge about the details in question and who are able to corroborate your version of events. Notify them in writing about the time, date and location of your court appointment.
- 5). Show respect for the court and the proceedings. Show up on time and dress professionally. Speak to the judge and the other litigants with courtesy and respect. Don't interrupt the judge or other litigant when they are speaking.
- 6). Present your case clearly and concisely. Write down the details of the case in chronological order before going to court. This helps you to remember the events and to organize your thoughts. Present your case in a straightforward manner. The judge is interested only in facts and evidence.
