Construction Accident Law
- The extent of construction law affects the injured worker, his immediate employer, general and sub-contractors, the property owner and project designer. Insurance companies also become involved, which can further complicate the legal process. Further, any contracts made must be reviewed for a possible connection to the accident.
- The International Labor Organization reports that every year nearly 60,000 fatal accidents occur on construction sites around the world, translating to one every 10 minutes. While not a legislative body, the ILO acts as an international influence upon legislative bodies with its Safety and Health in Construction Convention and Code of Practice.
- A typical relationship between a construction worker and her employing firm constitutes a duty-right relationship, where the employer has a duty to create a safe work environment and the worker has a right to such an environment. Further, those in positions of oversight increase their liability proportionate to their increased ability. For instance, an architect has more liability than an average worker.
