If a Case Is Under Advisement, Will It Be on Record as a Conviction?

- During the time period a case is under advisement no judgment has been entered by the court. A plea under advisement is a guilty plea that has not been finalized. A defendant will have no criminal record during this time period.
- The court usually imposes terms similar to probation on a defendant while the matter pending is under advisement. Violation of these terms will result in a conviction. That conviction will be on the defendant's record.
- While the case under advisement does not appear on the defendant's record, the arrest does appear. If the case is dismissed after taken being under advisement the defendant can ask the court to have the fingerprint and mug shot evidence removed.
