Florida House Lemon Law
- If a new home is discovered to have a construction defect, Florida consumers can sue the contractors or subcontractors under Chapter 558 of Florida Statutes Title XXXIII. Before seeking civil remedies, the homeowner must notify the contractor and provide an opportunity to repair the problem.
- If a homeowner believes that an inspector, developer or real estate agent knowingly provided false of misleading Information, that homeowner can seek compensation and attorney's fees. These provisions are listed under Florida statutes by profession or type of development. Chapter 475 of Title XXXII covers real estate brokers.
- Under Florida law, a developer who makes a good faith effort to comply with Florida's disclosure requirements and has substantially complied with those requirements, is protected from lawsuits for non-material errors or omissions. An example is Title XL of Chapter 718.
