How to Get Temporary Custody of Nephews
- 1). Get written consent from both parents. Unless the state has involuntarily removed your nephews from their parents' care due to abuse or neglect, you will need the written consent of both the mother and the father before you can get temporary custody of the children in most U.S. jurisdictions. If you do not know the whereabouts of the parents, you must make a diligent effort to locate them and document what steps you took.
- 2). Write a temporary custody agreement. To obtain the court's approval, prepare a document that outlines the terms of the custody agreement. List the names of both the children's parents, your nephews' names and birthdates, and your name and relationship to the children.
- 3). Explain why you are requesting temporary custody of your nephews. In your temporary custody agreement, detail the reasons why you want to care for the children. Additionally, list how long you wish for the custody arrangement to remain in effect.
- 4). Submit your documentation to the court. Once you have received the written consent of your nephews' parents, submit the consent forms and temporary custody agreement to the court in the state where the child current resides.
