Rights for a Part-Time Father

    Physical Placement

    • Part-time fathers are entitled to the placement time specified by their court order or separation agreement unless the document gives the mother the unilateral right to restrict the time upon the occurrence of certain conditions. Some jurisdictions allow for modification of the placement schedule if the mother unjustifiably denies the father his time with the children.

    Decision-making Authority

    • Depending on the type of custodial arrangement between the parties, a part-time father may have equal authority with regard to major medical, educational and religious decisions even if he only has a few days of physical placement per month.

    Access to Information

    • Depending on the type of custodial arrangement between the parties, a part-time father may also have equal access to the child's school, medical and dental information.

    Involvement in Activities

    • Unless a restraining order says otherwise, just because a soccer game, school play or parent-teacher conference occurs during the mother's time doesn't mean the father can't appear and take part in it, too.
