How to Sue a Small Business for Age Discrimination

    • 1). File a complaint with the Equal Employment Opportunity Commission (EEOC). The claim has to be filed within 180 days of the alleged discrimination. The EEOC can file this suit against the employer for you.

    • 2). Gather your evidence. Obtain all of the employer's statistics, including number of employees and any other information necessary. Document all instances of age discrimination, including dates, names and any possible witnesses. Gather evidence of your positive attributes as an employee, such as awards, promotions and positive reviews.

    • 3). Obtain the notice of right to sue from the EEOC. Once they have investigated your charge of age discrimination, you will be given a right to sue. The EEOC may decide to sue the small business on your behalf. But, they only do so with a small number of cases.

    • 4). Hire an attorney. Sue the small business for age discrimination in civil court. It's best to choose an attorney that specializes in employment law.

    • 5). Attend the trial. Dress in a professional manner and behave as such.
