How Do I File Slander Charges in Kentucky?

    • 1). Collect evidence of slander and resulting damages. Because slander does not have a written component, it is sometimes difficult to prove the act. Important sources of proof may include: recorded or televised conversations, testimony from witnesses present at the time and actions of other parties that imply the nature of the false claim. Damages typically require a monetary component such as losing a job, a contract under negotiation or loss of future income resulting from damage to one's reputation.

    • 2). Contact your local county court clerk and obtain filing forms. Alternatively, you can use the common civil cover sheet provided in the resources. State the facts of your claim in an attached petition and identify the relief sought. Complete and file the form, paying all applicable filing fees.

    • 3). Obtain and complete a civil summons to notify the defendant of a pending legal action. Provide the court with proof of summons, either by return receipt or by a sworn affidavit from the party serving the summons. Following the response of a summons discovery, hearing dates are set, allowing the trial to commence.
