How to Sue Someone in Civil Court - Small Claims Court
- 1). Gather the necessary information on the process for which to file suit in your state. This can be accomplished by heading down to or even calling your local courthouse. Request a brochure or book on the appropriate steps needed to be taken in order to file a civil lawsuit.
- 2). File your suit with your county's civil court system. Each court system has a different process but they are all similar in effect. You will be required to pay a filing fee upon filing. After you have filed they will provide you with a court date after the defendant has been notified.
- 3). Gather all of your evidence (paperwork, photos) together. If you have a witness, make sure you inform them of the date and time of your civil court hearing so they can be present. You should have two copies of all of your paperwork. One for the judge, and one for your own records.
- 4). Show up to court on your court date and plead your case. If you lose your civil suit, you can always appeal your case to the state.
